843 Suspension

Where discrimination was found on the basis of the unequal treatment of a Complainant who had been guilty of some misconduct, his first suspension would be rescinded to comport with the discipline imposed on a white employee with a similar record, the second suspension would be reduced in length on the theory that there would have been a less severe penalty on a first offense, but the third suspension would not be reduced because it could not be said that that suspension would have been unlikely to have occurred even if it had been handled non-discriminatorily.
