Index to Prohibited or Restricted Employment

An employment of minors work permit does not allow the employment of a minor in prohibited work and does not protect the employer if it allows the minor to do any work that is prohibited by statute or restricted by order.

Adult Bookstores

  1. Prohibited to all minors - all occupations
  2. Wis. Admin. Code § DWD 270.12(1).

Agricultural

  1. OK for 16 and over. Hours per week, time of day, and hazardous employments regulated.
  2. NOTE: This section does not apply to the employment of a minor engaged in farm work performed outside school hours in connection with the minor's own home farm and directly for his or her parent or guardian, or on another farm, with the consent of minor's parent or guardian where the farm work is primarily an exchange of labor with another farmer. Wis. Admin. Code § DWD 270.15.
  3. No permit is necessary.
  4. Prohibited under 16
    1. Operating or assisting in the operation of machinery, including, but not limited to, farm type tractors and other self-propelled vehicles. Except that minors trained under either the 4-H federal extension service or the U.S. office of education vocational agriculture training programs may work on equipment permitted by their certificate of training.     3. Working a yard, pen or stall occupied by a:

      3. Stud horse maintained for breeding purposes

      5. Cow with newborn calf (with umbilical cord present)
    4. Timber with butt diameter of more than 6 inches:
      1. Felling
      2. Bucking
      3. Skidding
      4. Loading
      5. Unloading
    5. Ladder or scaffold at a height of over 20 feet:
      1. Painting
      2. Repairing
      3. Building structures
      4. Pruning trees
      5. Picking fruit
    6. Driving a bus, truck or automobile when transporting passengers, or riding on a tractor as a passenger or helper
    7. Working inside:
      1. Fruit, forage or grain storage designed to retain an oxygen deficient or toxic atmosphere
      2. Upright silo within 2 weeks after silage has been added or where a top loading devide is in operation
      3. Manure pit
      4. Horizontal silo while operating a tractor for packing purposes
    8. Handling or applying agricultural chemicals identified by the word "poison" or the "skull and crossbones" on the label including the following:

Apprentices, Adult Program

Employment of minors permits are not needed for apprentices indentured by the Department of Workforce Development and they are NOT subject to prohibited employments when they are performing a service within the provisions of their contract. Wis. Stat. § 103.70(1) and Wis. Admin. Code § DWD 270.05(2)(e).

  3. These prohibitions do not apply to theatres, dinner theaters, or dances held solely for minors, conducted by private clubs or civics organizations.

Brick, Tile and Kindred Products

  1. OK for 16 and over in offices in silica brick manufacturers or silica refractories. All other activities prohibited.

CBRFs (Community-Based Residential Facilities)

  1. OK for 16 and over under the following conditions
    • CBRFs are not required to have licensed practical nurses or registered nurses on the premises at all times.
    • If students work as CNAs are employed under 18 years of age, they must work on site with another qualified caregiver; they may not work alone.
    • A facility waiver must be issued from the Department of Health Services, Division of Quality Assurance, for Youth Apprentice-ship students placed in CBRFs. CNAs (Certified Nursing Assistants)

Canning Factories

Carnivals

Car Washes

  1. OK for 14 and over IF no driving.
  2. OK for 15 and over to drive car on lot into wash, not on public streets.

Catering

  2. OK for 14 and over with adult supervision or without adult supervision IF work in office, workroom, or kitchen IF preparing and serving food and beverages with adult supervision including use of dishwashers, toasters, dumbwaiters, microwaves, popcorn poppers, blenders, automatic coffee machines, and devices used to maintain temperature of prepared food (such as warmers, steam tables and heat lamps).
  3. May not be sent to places of employment prohibited by employment of minors regulations
  4. May not work certain prohibited kitchen tasks, such as operating meat slicers or bakery machines.

Circular Saws, Band Saws, Chain Saws and Guillotine Shears

  1. OK for 16 and over IF power-driven fixed or portable machines are equipped with full automatic feed and ejection AND a fixed guard.
  2. Prohibited to ALL MINORS
    1. Operator or helper, setting up, adjusting, repairing, oiling or cleaning on the following power-driven fixed or portable machines.
      • NOTE: Setting up, adjusting, repairing & cleaning is allowable provided the tasks are completed electronically; in a manner so that the youth is not accessing sharp or moveable parts; OR the equipment is locked out/tagged out with no power.
      1. Circular saws
      2. Band saws
      3. Guillotine shears
      4. Chain saws

    4. The motor vehicle does not exceed 6,000 pounds gross weight.
    5. The minor has a valid driving license for the type of driving involved.
    6. The minor has no record of moving violations at the time of hire.
    7. The vehicle is equipped with safety belts and seat belt instruction is provided.
    8. The driving may not involve any of the following:
      1. Towing of vehicles;
      2. Route of deliveries or route sales;
      3. Transportation for hire of property, goods or passengers
      4. Urgent, time-sensitive deliveries;
      5. Transporting more than 3 passengers who are employees of the employer at any time.
  2. Prohibited to ALL MINORS - Outside helpers on motor vehicles. "Outside helper" means any individual, other than a driver, whose work includes riding on a motor vehicle outside the cab for the purpose of assisting in transporting or delivering goods.

CFR § 570.71 - Occupations involved in Agriculture

  1. Findings and declarations of fact as to specific occupations. The following occupations in agriculture are particularly hazardous for the employment of children below the age of 16:
    1. Operating a tractor of over 20 PTO horsepower, or connecting or disconnecting an implement or any of its parts to or from such a tractor.
    2. Operating or assisting to operate (including starting, stopping, adjusting, feeding, or any other activity involving physical contact associated with the operation) any of the following machines:
      1. Corn picker, cotton picker, grain combine, hay mower, forage harvester, hay baler, potato digger, or mobile pea viner;
      2. Feed grinder, crop dryer, forage blower, auger conveyor, or the unloading mechanism of a nongravity-type self-unloading wagon or trailer; or
      3. Power post-hole digger, power post driver, or nonwalking type rotary tiller.
    3. Operating or assisting to operate (including starting, stopping, adjusting, feeding, or any other activity involving physical contact associated with the operation) any of the following machines:
      1. Trencher or earthmoving equipment;
      2. Fork lift;
      3. Potato combine; or
      4. Power-driven circular, band, or chain saw.
      1. Bull, boar, or stud horse maintained for breeding purposes; or
      2. Sow with suckling pigs, or cow with newborn calf (with umbilical cord present)
    5. Felling, bucking, skidding, loading, or unloading timber with butt diameter of more than 6 inches.
    6. Working from a ladder or scaffold (painting, repairing, or building structures, pruning trees, picking fruit, etc.) at a height of over 20 feet.
